Sunday Examiner Chronicle May 9, 1982 trina B5 Deaths I Funerals Neil Bogart LOS ANGELES (AP) Neil Bogart, the entertainment magnate whose discoveries ranged from Donna Summer and Kiss to Curtis Mayfield and Melanie, died of cancer yesterday at Cedars Sinai Medical Center at age 39. Mr. Bogart's Casablanca Records and Filmworks made millions of dollars from films including "Midnight Express," "The Deep" and "Thank God It's Friday" and also struck gold in the late '70s with a string of disco hits by Summer and the Village People. Mr.

Bogart and his partners sold their controlling interest in Casablanca to the German-based Polygram Group two years ago, but he quickly founded yet another company, Boardwalk Entertainment, which is currently enjoying hits by such artists as Joan Jett and Richard "Dimples" Fields. In 1973, Mr. Bogart fulfilled his longtime dream of founding a record company of his own with the creation of Casablanca. His first major success there was with the then-unknown singer-producer team of Donna Summer and Giorgio Moroder. Casablanca's heyday ended with the demise of disco, and Mr.

Bogart sold out in March 1980. But he quickly was back in business with Boardwalk, whose artists included the late Harry Chapin, Mac Davis and Ringo Starr as well as Jett and Fields. Mr. Bogart was also active in community affairs, serving on the board of governors of Cedars Sinai Medical Center. He was executive vice president of the Betty Ford Cancer Society and also served as commissioner of the California Museum of Science and Industry and the Los Angeles Memorial Coliseum.

Mr. Bogart is survived by his wife, Joyce; four children; parents Ruth and AI Bogart of Encino; sister Bonnie Ermillio of Los Angeles; and brothers Lance Bogart of Hollywood and Ira Bogart of New York City. Donald B. Rice Donald Blair Rice, former president of Kiwanis International and retired business manager of the Oakland School District, died May 3 at Hill Haven Home at age 92. Mr.

Rice had been active with Kiwanis since 1922, serving as presi- and coordinator of the Northern California and Western States Championship dog obedience competitions. For 15 years, she was an active volunteer puppy tester at Guide Dogs for the Blind. Besides her husband, she is survived by sons Kenn, a filmmaker and San Francisco Chronicle copy editor, of Rockaway Beach, and Ezekial Marko of San Bruno, and a brother, Donald Halverson of Auburn. Funeral services will be at 2. p.m.

tomorrow at the San Bruno Funeral Home, 200 W. San Bruno San Bruno. Preferred are donations to Guide Dogs for the Blind, San Rafael. Margaret O. Dewell Margaret Orchison Dewell, assistant director of housing services at the University of California at Berkeley, died in Oakland Thursday.

A UC graduate, Mrs. Dewell was associate editor of the Blue and Gold in 1941 and a member of the Mortar Board and Prytanean honor societies. She is survived by a daughter, Adrienne Gilmore, and a sister, Adrienne Edmonston. Private services will be held tomorrow. Preferred are donations to the Margaret Dewell Gift Fund, 3476 Piedmont Oakland, to be used for a gift to the university.

Eza von der Lieth Special to The Examiner ST. HELENA Eza Sarthou von der Lieth, 89, widow of Dr. Harold Otto von der Lieth and member of a pioneer California family, died at the St. Helena Health Center here on Wednesday. She is survived by a son, Robert a daughter, Marie D.

Minority contractors and neighborhood housing activists agree that outright corruption and other legally suspect practices were preventing minorities from fully benefiting from the construction boom. They contend that the construction boom was ripe for exploitation because of high unemployment among minorities and a reluctance of white contractors to hire minorities, and because two government agencies responsible for monitoring projects were less than diligent in their oversight.

"For years we have been trying to get the Redevelopment Agency to stay on top of the contractors so extortion wouldn't exist and really push affirmative action programs," said Claude Carpenter, former chairman of the Bayview-Hunters Point Joint Housing Committee, an organization authorized by law to review all major construction projects in the area. "We constantly brought it to their attention that people were not getting work," Carpenter said. The Redevelopment Agency is responsible for monitoring major projects built on urban renewal land, such as the post office and the convention center. Under agency Minority Business Enterprise (MBE) guidelines, 15 percent to 20 percent of the construction dollar must go to minority-owned businesses. The city Human Rights Commission has responsibility for city projects that require minority participation of between 10 and 25 percent.

At the same time, the Redevelopment Agency requires contractors to make a "good-faith effort" to give 50 percent of all jobs on a craft-by-craft basis to residents in the community where the project is located. Community activists and contractors say the residential hiring requirement poses difficulty in an area such as Hunters Point, which has an abundance of painters, carpenters and laborers but few plumbers and electricians. "If a contractor couldn't meet his goals, he should contribute in some other way," Carpenter said, "rather than putting money in an extortionist's pocket." With an unemployment rate of more than 40 percent, residents find it frustrating because they can't find work at construction projects where millions are being spent, according to Oliver Patterson, a painting contractor working at the postal facility. "They watch white workers at 7 and 7:30 in the morning pulling in in their nice big trucks and cars, and taking money back out to Concord," Patterson said. Harold Brooks, head of Business Development an association of black contractors, also contended that minority firms fronting for white organizations have been able to win large MBE contracts and deprive genuine minority firms of large awards.

"The problem comes because it is too easy for major contractors to find a minority who will lend his name." Brooks said. Brooks said black contractors complained to the Human Rights Commission about the award of a major MBE contract at the southwest sewerage project to a venture they felt was a minority front. The $30 million award went to a joint venture composed of a black trucking firm and a white excavation company, he said. The firm previously had never done heavy, underground excavation, according to Brooks, and don't jump into it without any previous experience and knowhow, especially when you're not engineer yourself." But, The City claimed it "could find nothing wrong" with the joint venture. Stanley Lim, a monitoring official with the Human Rights Commission, said an investigation is conducted into the ownership of each MBE firm that is not listed in the commission's MBE directory.
